1. Introduction

These Terms and Conditions (“Terms”) govern the relationship between Wanderly Tours LLC (“we,” “our,” or “us”) and you (“you,” “your,” “traveler,” or “client”) when you book or use any of our travel services, including but not limited to vacation packages, tours, fl ights, hotels, transfers, and related activities.

By making a booking with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Booking and Payment

2.1 Booking Confirmation

A booking is confirmed only when we have received:

  • A completed booking request (inquiry, phone, or online)
  • The required deposit or full payment (as specifi ed in your invoice)
  • A signed booking confi rmation (if requested)
    All bookings are subject to availability. We reserve the right to decline any booking at our discretion

2.2 Payment Schedule

  • Deposit: A non-refundable deposit is required to secure your booking. The deposit amount will be specifi ed in your quote or invoice.
  • Final Payment: The remaining balance must be paid no later than 30 days prior to departure unless otherwise agreed in writing. If the fi nal payment is not received by the due date, we reserve the right to cancel the booking and retain the deposit.

2.3 Accepted Payment Methods

We accept payment by credit/debit card, bank transfer, or other methods as indicated on our website or invoice. All payments must be made in US Dollars (USD) unless otherwise agreed.

2.4 Price Guarantee

Prices quoted are based on current rates and availability. We reserve the right to adjust prices due to changes in currency exchange rates, fuel surcharges, taxes, or other external factors beyond our control. Any such changes will be communicated to you before fi nal payment.

3. Cancellations and Refunds

3.1 Cancellation by Traveler

Cancellation requests must be submitted in writing to [email protected]. The date of our receipt determines the applicable cancellation fees: the following are to be determined by the agent accordingly, based on the amount paid and the payable balance due.

Important: Some services (e.g., certain fl ights, hotels, or tours) may have stricter cancellation policies. In such cases, the supplier’s policy will apply and may result in higher fees, which we will disclose at the time of booking.

3.2 Refunds

If a refund is due, it will be processed within 30 days of the cancellation confi rmation, less any non-refundable supplier fees. Refunds will be issued using the original payment method.

3.3 Cancellation by Wanderly Tours LLC

We reserve the right to cancel a tour or package due to insuffi cient participation, force majeure, or other circumstances that make operation unsafe or impossible. In such cases, you will receive a full refund of all payments made, or you may choose to apply the funds to a future booking. We are not liable for any additional expenses incurred (e.g., airline change fees, accommodation costs).

4. Changes to Bookings

4.1 Changes Requested by Traveler

If you wish to change your booking (dates, itinerary, or number of travelers), we will make every effort to accommodate. Any change is subject to availability and may incur administrative fees (typically $100 per change) plus any additional costs imposed by suppliers. Changes requested within 30 days of departure may be treated as a cancellation and rebooking.

4.2 Changes Made by Us

We reserve the right to modify itineraries, substitute hotels, or adjust transportation when necessary due to operational reasons, safety concerns, or unforeseen events. We will notify you as soon as possible. If a signifi cant change is made before departure, you may accept the change or receive a full refund.

5. Travel Documents and Requirements

5.1 Passport and Visas

It is your sole responsibility to ensure that you and all members of your party possess valid passports (with at least six months’ validity beyond the intended return date), visas, and any other documents required for entry into the countries you will visit. We can provide guidance, but we are not liable for any denial of entry or costs incurred due to inadequate documentation.

5.2 Health and Vaccinations

You are responsible for complying with all health requirements, including recommended or mandatory vaccinations, for your destinations. We encourage you to consult a travel health specialist well before departure.

5.3 Travel Insurance

We strongly recommend purchasing comprehensive travel insurance that covers trip cancellation, medical expenses, evacuation, baggage loss, and other contingencies. We offer optional travel insurance plans; details are available upon request.

6. Liability and Responsibility

6.1 Our Role

Wanderly Tours LLC acts as a coordinator and booking agent for travel services provided by third parties (airlines, hotels, tour operators, etc.). We do not own or operate these services and are not liable for any injury, loss, delay, or damage arising from their acts, omissions, or negligence.

6.2 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, terrorism, strikes, government regulations, pandemics, or severe weather.

6.3 Limitation of Liability

To the fullest extent permitted by law, our total liability for any claim arising from your travel arrangements is limited to the amount you paid us for the specifi c service that gave rise to the claim.

6.4 Assumption of Risk

You acknowledge that travel involves inherent risks (health, safety, property) and you assume those risks. You agree to release and hold us harmless from any claims arising from your participation in any travel activity.

7. Photographs and Marketing

We may take photographs or videos during our tours for promotional purposes. By booking, you consent to the use of your image in such materials unless you notify us in writing before departure. We will not use your likeness for commercial purposes outside of our own marketing without your explicit permission.

8. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Colorado, without regard to its confl ict of laws principles. Any dispute arising out of or relating to these Terms or your travel arrangements shall be resolved through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.

9. Miscellaneous

9.1 Entire Agreement

These Terms, together with your invoice and any additional written agreements, constitute the entire agreement between you and Wanderly Tours LLC.

9.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

9.3 Changes to Terms

We may update these Terms from time to time. The latest version will be posted on our website, and your continued use of our services constitutes acceptance of the updated Terms.
